1. The Service

AgentDesk provides a customer relationship management (CRM) platform designed for independent insurance agents. By using our service, you agree to these terms.

We reserve the right to modify, suspend, or discontinue the service at any time with reasonable notice. We will make reasonable efforts to notify you of significant changes.

2. Your Account

To use AgentDesk, you must:

  • Be at least 18 years old
  • Provide accurate and complete information when creating your account
  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access to your account

You are responsible for all activity that occurs under your account.

3. Your Responsibilities

You are responsible for:

  • The accuracy and legality of all data you enter into AgentDesk
  • Obtaining any necessary consents from your leads and clients for storing their information
  • Complying with all applicable laws and regulations in your use of the service
  • Maintaining backups of your important data

4. Acceptable Use

You agree not to:

  • Use the service for any illegal purpose
  • Attempt to gain unauthorized access to any part of the service
  • Interfere with or disrupt the service or servers
  • Upload malicious code or content
  • Share your account credentials with others
  • Resell or redistribute the service without permission

5. Payments & Billing

Free Trial: New users receive a 14-day free trial with full access to all features. No credit card is required during the trial.

Subscription: After your trial, you may subscribe to continue using AgentDesk. Subscriptions are billed in advance on a monthly or yearly basis.

Cancellation: You may cancel your subscription at any time. You will continue to have access until the end of your current billing period. We do not provide refunds for partial billing periods.

Price Changes: We may change our prices with 30 days notice. Early access pricing is locked in for the duration of your continuous subscription.

6. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the service. We are not liable for any downtime, whether scheduled or unscheduled.

We may perform maintenance that temporarily affects availability. We will make reasonable efforts to notify you in advance of scheduled maintenance.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AGENTDESK AND ITS OWNERS, EMPLOYEES, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Any loss of profits, revenue, data, or business opportunities
  • Any damages arising from your use or inability to use the service

Our total liability for any claims arising from your use of the service shall not exceed the amount you paid us in the 12 months preceding the claim.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

9. Termination

You may close your account at any time by contacting us.

We may suspend or terminate your account if you violate these terms or if we reasonably believe your use of the service may harm AgentDesk or other users.

Upon termination, your right to use the service will cease immediately. We may delete your data after termination, subject to our data retention policy.

10. Changes to These Terms

We may update these terms from time to time. We will notify you of material changes by email or through the service. Your continued use of the service after changes take effect constitutes acceptance of the new terms.

11. Governing Law

These terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these terms or your use of the service shall be resolved in accordance with applicable law.
